Hi,
I got laidoff recently. My company is going to withdraw H1b. I have my 140 approved from same company and my 485 pending. I have EAD and never used and working on H1B for the same company. I was working for the same company which processed my H1B.
If H1B is withdrawn is there going to be any effect on my 485? like any possibility of RFE on 485 for EVL? My employer said they will not withdraw or revoke 140.
How long will it take to withdraw H1B?

I had my Labor go through without any issues. I haven't yet applied for 140.
what would happen if I apply for F-1 visa to pursue my studies as full time student since F-1 is a non-immigrant visa and I have cleared my labor.
I know I can't proceed with 140 since its a petition for immigrant status and my F-1 will be rejected. My question is does labor certification also affects F-1 visa application?

My wife switched from h4 to f1 status. you can do the same and status studies, assuming you have valid status/visa right now. Later you can get visa stamped.
H visa is dual intent, and f is non-immigration. Since you already have h visa it will not be a trouble. This is from my experience and some of my friends.

My attorney has asked for the I-485 to be printed:
double sided with Flip to Top option.
Did anyone else do the same?
for what its worth I printed mine single sided. I hope USCIS is not as nitpicky as your lawyer. I printed in black ink, maybe if it was pink or green or orange they might raise an eyebrow, otherwise I hope they dont really care

As long as the water is all of the same temp and salinity there isn't any distortion because of water movement. Distortion does occur when you get mixing of water that has different density. Scuba diving you see that where you pass through layers of water on the way down. The layers can be either different temerature or different salinity. When you get that it looks like heat waves on a hot highway in the distance.
I have used the pentax optio under water a bit. It works well as a point and shoot but not much more than that. I wouldn't take it more than a few feet down. I don't think it is rated for very deep.

I am planning to apply for Schengen visa in an Italian consulate. I have an expired H1 but a valid AP. According to the italian consulate website, here is one of the visa requirements
"passport or travel document valid for at least three months after visa expiry date"
My passport is expiring in 2 years but my AP will be expiring in about 2 1/2 months from the Schengen visa expiry. Will I have an issue getting a visa ?
Do I have a workaround ?

We (parents) had applied for family based concurrent AOS in Aug, 2008 while we were on
tourist visas. We are now in India on Advance Parole(valid till Aug. 2009) that we received
after filing AOS.
Today(Feb, 2009) production of green card has been ordered for my wife and will soon be
received in USA. My case is still pending but we expect it processed soon. Thanks for all
the help.
My questions is
(a) What documents we need to show at immigration on returning to USA?. We have I-485
Notice, Advance Parole and valid Passports.
(b) Do we need to request somone in USA to mail our green cards on receipt.?
(c) How much maximum time we still can stay in India.? We wish to stay here for another 1-2
months. In any case making travel arrangements etc. is likely to take atleast 2 weeks.
(d) But is there a time limit for returning?
(e) Can we safely enter 2-3 months after the cards are received in USA, and
(f) sending GC by mail is not objectionable?
Also, in totality, Which one of these scenarios is correct:
1) Do we have to return immediately on approval of green card, enter with advance parole
only and it is not legal to mail green cards?
OR
2) It means if we can get our cards mailed and receive it here, we can safely travel back
with our green cards, even after 2 months of its receipt in USA. Overstay abroad is not an
issue whether it is 2 weeks, 2 months or even more. Am I right?

While I did not learn anything new about what is happening at Sacramento USCIS, I did learn about new procedures being applied to applicants applying for visas abroad.
It seems that applicants who have tattoos are being screened more carefully at their medical appointments. The belief is that an individual with a tatoo may be involved in gang activity which furthermore may lead to that individual engaging in substance abuse. In a published article included in conference materials at the American Immigration Lawyers Association�s (�AILA (http://www.aila.org/)�) annual conference, immigration lawyers Fernando Rojas and Magda Montiel Davis, explain what is happening:
Panel physicians are asking applicants about the meaning of their tattoos and the medical personnel conducting the exam will take notes describing the tattoo. This interrogation could lead to further questions about the applicant�s possible gang affiliation and criminal history. Applicants with tattoos are also being questioned by the panel physician regarding their substance abuse history. Apparently, panel physicians are making the assumption that applicants with tattoos are more likely to do or abuse drugs. If the beneficiary admits to any drug use, Consulates will use this information against the applicant in order to deny the visa by making a substance abuse finding against them.A finding of substance abuse is serious because an applicant who is a drug user or abuser may be denied admission to the United States pursuant to Immigration and Nationality Act Section 212(a)(1)(A)(iv) (http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=9b60c646835045a30ceca097f0ca1 ba3). I would counsel anyone carefully who has a tattoo to be very honest about what the tattoo means.
