In my case I work for startup and I'm the only one who they are sponsoring for GC (rest all are either US citizens, GC holders or contractors) and my I140 is already approved, so ability to pay is not a concern with my company.
While I have a good rapport with the CEO etc, I am nervous that they might revoke I-140 in case they have lay offs that affect me. I was looking for some articles or USCIS documents that say that there is no requirement to revoke I-140.
Its just harder to prove that there are no such requirements other than saying "look, you couldn't find anything that says you should revoke I-140, therefore don't do it". It would be more convincing if I find something more explicit that says there is no such requirement.

My passport is expiring in March. I live in NY metro . Does anyone knows the procedure to renew the passport while in the USA. Please share your experience.
Its very easy and simple. Go to NY Indian Embassy web site and follow the procedure/process to renew passport. It takes about 1-2 weeks, after you mail the old passport along with other documents, for Indian Embassy to process and mail you back the new passport. Good Luck!

My company filed an I-140 in December 2009. The petition (an EB2) was APPROVED in May 2010. A month or so later, I was laid off but BEFORE the I-485 was ever filed. As far as I know, the I-140 has not been revoked. What are my potential options here? Can I find a new employer to file a 485 provided the new job is similar to the I-140 petition or do they have to start the whole process again?
No...need to start the GC from scratch. You can not use your I140 as you no longer employed by the GC sponsor and can not use AC21 as I-485 was not filed.

My aunt petioned for my mom (and thus her kids) years ago, My aunt's a Us citizen, and after many years the process has started its final run. For the last two years i was an F1 student in a college in the usa and recently ive come back home; while i was there i married randomly anyway, nothing happened it wasnt a real marriage, and im getting it annuled.
So now im back home and since this process (my aunts petition) has started , im 21 but im covered aswell since the child status protection act covers me. Now, the requirements for the children (derivative beneficiaries) of the aplicant/beneficiary (my mom) to be included are to be under.. 21 (im ok in this part because of CSPA) and UNMARRIED. My question is,,, am i still gonna be included if i show my annulment certificate? as i see it the annulment itself shows that an american court declared that marriage to be voidable and not real so it should make me unmarried.right? would it also be unmarried for immigration purposes if it was divorce instead of annulment? i'd appreciate any feedback, thank you.

Hello,
I am Dec 02/EB3/India candidate. Currently using EAD/AP to work. No H1b visa.
My current project � SAP PI implementation requires me to travel to London / Ontario, Canada, on a weekly basis. This is going to be for few months at least. Employer is in US, major work place will be US, still working with original employer who filed GC; even residence is in US.
Has anyone travel more than once on AP?
Is that ok or there are risk factors?
Has anyone traveled on AP using car by road? How is experience compared to enter via airport?
Any help will be highly appreciated.

This is my agreement with C :-
During the term of the assignment & for a period of 1 Year following the termination of the business/employment relationship between C & cygent, cygent will not do any of the following:
1. Directly or indirectly call on, solicit, or take away (directly or through another entity) any of C's customers or potential customers cygent became aware of as a result of performing services for the above referenced assignment; or
2. Directly or indirectly offer or attempt to offer (directly or through another entity) services that were offered via C for the same projects that were performed under the agreements between C & cygent, or
3. solicit or hire away any of C's employees or contractors C became aware of as a result of performing services under agreements between cygent & C.
cygent will be held responsible for any losses suffered by C due to violation of the terms stated in this agreement. jurisdiction is County of Alameda, California.

That was an old news. Around 60000 visa's were pre-allocated to pending applications before July 2nd, 2007. I would be very surprised if the numbers are not much more than 18000 for India EB3. India used to get around 40-45 K visas per year for all EB categories before 2005 since the soft quota was introduced. All these numbers are avilable on USCIS website.

I have been trying to use the POJ method to reach an IO but looks like USCIS has shutdown that option. After entering the receipt number it simply reads out the online status message and does not provide any option to reach a CSR.
Looks like eccessive status calls have caused this.

Federal Reserve Chairman Ben Bernanke said that on September 15, 2009, the worst recession since the 1930s is probably over, although he cautioned that pain - especially for the nearly 15 million unemployed Americans - will persist. What is the best possible solution to get around different place birth on Passport and BC. Any has affidavit format for such issue please share it.
According to chat transcript from a lawyer's site some one had the same question. The answer is "USCIS does not care much about secondary document like passport and what's in the primary document like Birth certificate is important and matters". In other words they may not be comparing the passport and birth certificate for place of birth. Just my 2cents as I'm not a lawyer.
